Plain language up front

These terms govern your use of the chimtx.com website and any inquiry you make through it. The actual contract for any work we do for you is a separate written agreement signed by you and Chim-Tex Construction. Nothing on this website creates that contract by itself.

Use of the website

You may browse the site, read the content, and submit inquiries through the contact form. You may not scrape the site at scale, attempt to compromise its security, impersonate us, or use the site to send unlawful or harassing material to us or anyone else.

The content on this site, including text, images, and the visual identity, is owned by Chim-Tex Construction or used with permission. You may reference or link to the site in normal commercial or personal communication. You may not republish substantial portions of the content without our written permission.

Information on the site

We work to keep the information accurate. Service descriptions, pricing ranges, code references, and project timelines are presented as good-faith examples, not binding quotes. Building codes change. Manufacturer specifications change. Our pricing changes with materials and labor markets. The only binding pricing, scope, and timeline is what appears in the written quote and signed contract for your specific project.

Inquiries are not contracts

Submitting an inquiry through the contact form, calling, or emailing us does not create a contract for work. It starts a conversation. The contract is formed only when you and Chim-Tex Construction sign a written agreement covering the specific scope, price, timeline, and terms of your project.

Workmanship warranty

Every project closes with a written workmanship warranty. The specific terms (duration, scope, exclusions) are part of the project contract. Manufacturer warranties on factory-built fireplace units, burner assemblies, and other components are separate from our workmanship warranty and are governed by the manufacturer's terms. We provide registration and documentation at handoff.

Limitation of liability for website use

The website is provided "as is" without warranty for the purposes of browsing. We do not guarantee uninterrupted access, freedom from bugs, or fitness for any particular purpose with respect to the website itself. To the extent permitted by Texas law, Chim-Tex Construction is not liable for damages arising solely from your use of the website. This limitation does not apply to the work we perform for you under a signed contract; those terms govern liability for the work itself.

Privacy

Use of the website is also subject to our privacy policy, which describes what information we collect and how we use it.

Governing law

These terms are governed by the laws of the State of Texas. Any dispute arising from the website is subject to the exclusive jurisdiction of the courts of Harris County, Texas. Disputes arising from a specific project contract are governed by the dispute-resolution terms in that contract.

Changes to these terms

We may update these terms from time to time. The "last updated" date reflects the most recent revision. Continued use of the website after a material change constitutes acceptance of the updated terms.
